A Resolution for Approval of a License Agreement with Everstream for the Installation of Telecommunications Facilities within the Rights of Way

Whereas, Everstream GLC Holding Company LLC has requested permission to install fiber optic telecommunications facilities within the Village of Romeoville's rights of way; and,

Whereas, the Village has proposed to enter into a master license agreement with Everstream to enable proper facilitation and management of the installation of telecommunications facilities and to allow approval of individual permits for such installation of telecommunications facilities for an initial five-year term and the renewal of the license agreement for additional five-year terms subject to compliance with the terms and conditions of the agreement; and,

Whereas, Everstream shall pay a license fee to the Village for each five-term that the license agreement is in effect, the amount for the initial five-year period being $2,500.00 and the amount for each subsequent five-year period being redetermined at the time of each renewal.

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.

Section 2: Approval of License Agreement: The license agreement is hereby approved under the conditions and terms contained therein.

Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.

Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, claus...
