A Resolution Authorizing the Waiving of Bids for the Installation of a Retaining Wall (Pine Trail Drive)

WHEREAS, the Village of Romeoville has heretofore constructed a multi use path in conjunction with the development of Pine Trail Park; and
WHEREAS, to facilitate ongoing maintenance, the Village has determined that it is necessary to install a retaining wall adjacent to a certain segment of the aforesaid path, at or near the intersection of Pine Trail Drive and Naperville Road; and
WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of two-thirds of its Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and
WHEREAS, the Village of Romeoville has solicited three proposals for the construction of the aforesaid retaining wall, and has received one proposal in response, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
Section 1: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: By a two-thirds vote of the corporate authorities of the Village, applicable competitive bidding requirements under the Illinois Municipal Code and the Village Code of Ordinances are hereby waived, and the proper officers of the Village are hereby authorized and directed to execute a contract and/or other related documentation for the construction of the retaining wall as hereinabove mentioned, consistent with the terms of the proposal from J.
