A Resolution Authorizing the Village Manager to Contract with JB Contracting for Electrical Work in Connection with the Aquatic Center Project

WHEREAS, the Village of Romeoville has heretofore entered into agreements with Harbour Contractors, Inc. for the provision of preconstruction and construction management services for the construction and development of the Aquatic Center project (the “Project”); and

 

WHEREAS, the Village and Harbour are in the process of soliciting proposals for work on the various portions of the Project, and desire the ability to flexibly and timely negotiate and contract with the various contractors providing proposals to the Village in order to facilitate the timely prosecution and completion of the Project in the manner most economically advantageous to the Village; and

 

WHEREAS, to provide the Village with the ability to flexibly negotiate and accept proposals and contracts pertaining to the performance of work on the Project, and to enable the Village to promptly secure proposals and contracts on terms most economically advantageous to the Village in the current contracting environment, it is in the best interests of the Village to authorize the Village Manager to enter into contracts and to accept proposals relating to the performance of work on the Project in an aggregate total amount not to exceed $15,000,000, subject to the subsequent ratification of all such contracts and proposals by the Village Board of Trustees, and the Board has heretofore adopted Resolution No. 21-3194 to so provide; and

 

WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may by a two-thirds vote of its Trustees then holding office waive the requirements for public bidding on Village public work, or improvement projects; and

 

WHEREAS, it is now in the best interests of the Village to award a contract for electrical work to JB Contracting in an amount not to exceed $1,934,598.00, and to authorize the Village Manager to execute a contract for such work together with all other documentation required in connection therewith.

 

NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:

 

Section 1:                     Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.

 

Section 2:                     Waiver of Bids; Authorization of Village ManagerPursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the acceptance and execution of proposals or contracts for work on the Project, and authorizes the Village Manager to award a contract for electrical work to JB Contracting in an amount not to exceed $1,934,598.00, and to execute a contract for such work together with all other documentation required in connection therewith, all subject to final Village Manager and Village Attorney review and approval.

 

Section 3:                     Repealer: All other Resolutions or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.

 

Section 4:                     Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions, or sections thereof.

 

Section 5:                     Effective Date: The Resolution shall take effect after its passage, approval, and publication in pamphlet form, as regulated by law.
