An Ordinance Amending Chapter 35 of the Village Code of Ordinances-Boards and Commissions-Board of Police and Fire Commissioners (New Appointments)

                     WHEREAS, a periodic review of the ordinances of the Village of Romeoville has indicated that certain revisions to the minimum qualifications to appointment as a sworn officer of the Village of Romeoville Police Department are necessary to permit the expansion of the pool of eligible applicants for the position to include lateral appointments of individuals presently serving as sworn law enforcement officers with law enforcement agencies in the State of Illinois whose knowledge, skills, abilities and level of experience meet specific and defined needs of the Romeoville Police Department; and

 

                     WHEREAS, the Village of Romeoville is a home rule municipality under the Illinois Constitution of 1970; and

 

                     WHEREAS, it is in the best interests of the Village to enact the amendments to Chapter 35 of the Village Code of Ordinances as more fully hereinafter set forth and in the exercise of the Village’s home rule authority.

 

 

                     NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

 

                     SECTION 1:  RECITALS.  The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

 

SECTION 2:  AMENDMENT TO CHAPTER 35.04.  All those heretofore enacted ordinances of the Village codified as and for Chapter 35.04 of the Village Code of Ordinances are hereby amended to read as follows:

 

35.04 MINIMUM QUALIFICATIONS FOR POLICE OFFICERS-NEW APPOINTMENTS.

 

   The Board of Police and Fire Commissioners is hereby authorized to adopt further rules and regulations requiring candidates for new or initial appointment to the position of police officer in and for the village to possess at least one of the minimum qualifications set forth below:

 

   (A)   Satisfaction of all applicable requirements established from time to time by the Illinois Law Enforcement Training Standards Board (“ILETSB”);

 

   (B)   Certification as a police officer having successfully completed the Minimum Standards Basic Law Enforcement Training Course as required by the Illinois Police Training Act; or

 

   (C)   In lieu of the criteria set forth above, not less than 24 months in the active service of the United States Military, and an honorable discharge from such service, or in lieu of an honorable discharge, current service in an active or inactive reserve capacity.

 

The Board of Police and Fire Commissioners shall further be authorized from time to time to adopt additional rules and regulations prescribing other and further qualifications for new or initial appointment to the position of police officer which are not inconsistent with the foregoing requirements, and provided further, that no such rules and regulations shall have the effect of reducing the qualifications for new or additional appointment to the position of police officer below the minimum requirements from time to time established by the ILETSB.

 

 

SECTION 3:  SEVERABILITY.  That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 4:  CONFLICTS.  All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency. 

 

                     SECTION 5: EFFECTIVE DATE.  This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
