A Resolution to Waive the Bid Process and Accept the Proposal from Denler, Inc. for the Placement of High-Density Mineral Bond Surface Treatment on Various Multi-Use Paths Throughout the Village

 

Body

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,

 

Whereas, the expenditures for pavement surface treatment are allocated in the Fiscal Year 2021/2022 Budget; and,

 

Whereas, a proposal of $96,497.41 has been received from Denler, Inc. for the placement of high-density mineral bond surface treatment and crack sealing at various multi-use paths throughout the Village; and,

 

Whereas, $180,000 has been included in this year’s budget for these surface treatments.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:

 

 

Section 1:                     Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.

 

Section 2:                     Waiver of Public Bid RequirementsPursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the placement of pavement surface treatments.

 

Section 3:                     Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.

 

Section 4:                     Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.

 

Section 5:                     Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
