A Resolution To Approve A Proposal From Hitchcock Design Group For Phase I Of The Diocese Property Dog Park Project.

WHEREAS, the Village of Romeoville has heretofore reviewed proposals for Hitchcock Design Group For Phase I Of The Diocese Property Dog Park Project; and
WHEREAS, the Village desires to accept the proposal for $82,300 with Hitchcock Design Group based on the long-standing relationship with their professional staff and the excellent work that they have completed within the Village over many years; and
WHEREAS, the Village of Romeoville is an Illinois home rule municipal corporation under the 1970 Illinois Constitution; and
WHEREAS, a copy of the proposal is attached to this Resolution and incorporated herein by references as Exhibit A; and
WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of two-thirds of its Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
Section 1: The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.
Section 2: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable to the provision of Hitchcock Design Group related to the Diocese Property Dog Park Project, and the Village President and Village Clerk are hereby respectively authorized to execute and attest to the execution of a proposal for $82,300 with Hitchcock Design Group related to the Diocese Property Dog Park Project with proposal accepted herein and execute any further documents necessary to effectuate the same in substantially the form attached hereto and incorporated herein as Exhibit A.
Section 3: That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
Section 4: All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
Section 5: This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
EXHIBIT A
VILLAGE OF ROMEOVILLE/ HITCHCOCK DESIGN GROUP TERMS, CONDITIONS AND PROVISIONS FOR PHASE I OF THE DIOCESE PROPERTY
DOG PARK PROJECT
Upon the Village’s written receipt from Hitchcock Design Group of written acceptance of the terms, conditions and provisions of this resolution, said terms, conditions and provisions, including but not limited to the terms, conditions and provisions set forth below in this Exhibit A, shall serve as and for a proposal between the Village of Romeoville and Hitchcock Design Group for Phase I of the Diocese Property Dog Park Project.
