A Resolution to Waive the Bid Process and Enter into a Contract for the 2021 Subdivision Street Resurfacing Project

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, the expenditures for the 2021 Subdivision Street Resurfacing Project are allocated in the Fiscal Year 2021/2022 Budget; and,
Whereas, three proposals were received for the 2021 Subdivision Street Resurfacing Project, and the lowest proposal was submitted by Orange Crush LLC in the amount of $1,062,840.00, and the ultimate contract value will reflect the actual quantities of work performed in the field, up to an approved budgeted amount of $1,200,000 or, as combined with the hot-mix asphalt program and concrete repair program, up to a total approved budgeted roadway program amount of $2,100,000.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the contract for the 2021 Subdivision Street Resurfacing Project.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
