A Resolution Waiving the Bids and Authorizing an Agreement between the Village of Romeoville and Waste Management

Whereas, The Village of Romeoville (“The Village”) is a municipality in accordance with the Constitution of the State of Illinois of 1970; and,
Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, Village Staff received a proposal from Waste Management for the provision of garbage, refuse, recycling and yard waste collection services; and,
Whereas, the Village of Romeoville is currently working with Waste Management for the provision of these services under an existing agreement due to expire at the end of April 2021; and,
Whereas, the expenditures for these improvements are allocated in the budget; and,
Whereas, Village Staff has reviewed the proposals and recommends the Village Board award the contract to Waste Management;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to this project, and authorizes the execution of a contract with Waste management substantially in the form attached hereto and incorporated herein as Exhibit A.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval,
and publication in pamphlet form, as provided by law.
