A Resolution to Waive the Bid Process and Accept the Five-Year Contract Sludge Hauling from Stewart Spreading

Body
Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,

Whereas, the expenditures to accept the five-year contract from Stewart Spreading for complete biosolids management services including, Loading, Transportation, Land Application of biosolids with Agronomic; and,

Whereas, the Village has approved $300,000 in the FY 20/21 Budget for the sludge hauling. The contract rate of $19.79 is fixed for 24-months. Rate per cubic yard will be adjusted annually on January 1 for contract years 2023 - 2025 with a CPI adjustment; and,

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:

Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.

Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the five-year contract sludge hauling from Stewart Spreading in the amount of $19.79 per cubic yard.

Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.

Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, ph...
