A Resolution Authorizing the Waiving of Bids for the Purchase and Installation of Playground Equipment at Pine Trail Park

WHEREAS, the Village of Romeoville is in the process of designing and planning the development of Pine Trail Park; and
WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of two-thirds of its Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and
WHEREAS, the Village of Romeoville has heretofore received a quote from Cunningham Recreation for playground equipment to be supplied for Pine Trail Park in the amount of $83,139.06 (see Exhibit A); and
WHEREAS, the Village has determined that it is in its best interests to purchase the proposed equipment prior to scheduled price increases taking effect in December of 2020, and will by appropriate resolution provide for the installation of the same at a later date.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
Section 1: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: By a two-thirds vote of the corporate authorities of the Village, applicable competitive bidding requirements under the Illinois Municipal Code and the Village Code of Ordinances are hereby waived, and the proper officers of the Village are hereby authorized and directed to execute the purchase order for playground equipment for Pine Trail Park, pursuant to the terms of the proposal attached hereto and incorporated herein as Exhibit A to this Resolution, subject to final Village Manager and Village Attorney review, and upon Cunnningham Recreation’s written acceptance of this Resolution, this Resolution shall serve as and for a contract between the Village and Cunningham Recreation for the provision of the aforementioned playground equipment.
Section 3: That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
Section 4: All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
Section 5: This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
