An Ordinance Amending Chapter 43 of the Village Code of Ordinances (Fee Schedule)-Department of Community Development

                     WHEREAS, the Village of Romeoville has heretofore adopted certain ordinances now codified as and for Chapter 43 of the Village Code of Ordinances and as other provisions of the Village Code of Ordinances setting forth and establishing various fees and charges for licenses, permits, approvals and the like; and

 

                     WHEREAS, the ongoing COVID-19 public health emergency has and will continue to disproportionately affect the restaurant and bar segments of the Village of Romeoville business community due to the impact of State of Illinois mitigation guidelines on indoor restaurant and bar service; and

 

                     WHEREAS, in light of the financial hardships that the COVID-19 public health emergency has thus placed on the restaurant and bar segments of the Village of Romeoville business community, the corporate authorities of the Village of Romeoville find that it is necessary and appropriate to amend the pertinent provisions of Chapter 43 of the Village Code of Ordinances to suspend the applicability of business license fees for restaurant and bar business within the Village of Romeoville for 2021.

 

 

                     NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, THAT:

 

                     SECTION 1:  RECITALS.  The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

 

SECTION 2:  AMENDMENT OF CHAPTER 43 OF VILLAGE CODE OF ORDINANCES.  All those provisions of all heretofore adopted Village ordinances codified as Section 43.01(C) of the Village Fee Schedule-Department of Community Development Fee Schedule shall hereby be amended to read as hereinafter set forth:

 

(C)   Business licenses.  A business, as hereinafter defined, shall be charged an annual business license fee based on the total floor area devoted to the business, except that food establishments as hereinafter defined and home occupations as hereinafter defined shall be charged a license fee specific to those particular types of businesses.  For purposes of the foregoing, the business license year shall begin on January 1 of every calendar year and shall end on December 31 of the same calendar year. There shall be no proration of annual business license fees.  In addition to the business license fee applicable as described in the preceding sentence, any business that also operates as a tobacco dealer, as hereinafter defined, shall be charged an additional license fee to engage in the business of a tobacco dealer.  Notwithstanding the foregoing or any contrary provision of this Section 43.01(C), no business that is principally and primarily engaged in the business of a food establishment as defined in this Section and required to obtain a business license as such shall be required to pay the otherwise applicable fee for such license with respect to the business license year beginning on January 1, 2021 and ending on December 31, 2021, but such business shall be subject to all other provisions of this Code of Ordinances as may apply thereto.

 

                     SECTION 3:  SEVERABILITY.  That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 4:  CONFLICTS.  All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency, and upon such repeal the relevant substantive provisions thereof shall be deemed to be replaced with the relevant substantive provisions hereof.

 

                     SECTION 5: EFFECTIVE DATE.  This Ordinance shall be in full force and effect from and after its approval and publication in pamphlet form as provided by law.
