An Ordinance Authorizing an Intergovernmental Agreement between the Village of Romeoville and the Village of Lemont

WHEREAS, units of local government are enabled by Article VII, Section 10 of
the Constitution of the State of Illinois of 1970 to enter into agreements among
themselves in order to exercise, combine or transfer any power or function, in any manner not prohibited by law or ordinance; and

WHEREAS, the Village of Romeoville and the Village of Lemont seek to enter into the Intergovernmental Agreement in substantially the form attached hereto and incorporated as Exhibit A as an exercise of their respective authority as an exercise of their intergovernmental cooperation authority under Article VII, Section 10 of the Constitution of Illinois.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

SECTION ONE. The foregoing Recitals are hereby incorporated into this Ordinance as if fully set forth in this Section 1.

SECTION TWO. That the Village President is authorized and directed to execute the Intergovernmental Agreement in substantially the form attached hereto and incorporated as Exhibit A, and the Village Clerk is hereby authorized and directed to attest thereto, subject to final review and approval by the Village Manager and the Village Attorney.

SECTION THREE. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

SECTION FOUR. All prior Ordinances and Ordinances, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
