A Resolution to Waive the Bid Process and Allow Sanitary Force Main Replacement to be Performed in Conjunction with the Weber Road Reconstruction Project

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,

Whereas, the expenditures for the Village's expenses associated with the Weber Road Reconstruction Project have been budgeted for in the Fiscal Year 2020/2021 Budget; and,

Whereas, a proposal was received by the Will County Division of Transportation from the contractor for the Weber Road reconstruction project, R.W. Dunteman Co., to replace 730' of sanitary force main within the project limits that has been identified as not have sufficient clearance from the water main per EPA regulations.

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.

Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to sanitary sewer replacement.

Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.

Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases,...
