A Resolution Waiving the Public Bidding Process and Authorizing the Acceptance of a Proposal from HTC Commercial Flooring In An Amount Not To Exceed $40,000.00

WHEREAS, pursuant to the provisions of 65 ILCS 5/9-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of tis Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and
WHEREAS, the Village of Romeoville has determined to accept a proposal for the installation of new flooring in several rooms in the Recreation Center for the Village Parks and Recreation Department; and
WHEREAS, the Village of Romeoville has previously contracted with HTC Commercial Flooring for the installation of flooring at the Recreation Center, and has been pleased with the workmanship, service and product quality; and
WHEREAS, the Village of Romeoville desires to waive the bidding process and accept a proposal from HTC Commercial Flooring for the replacement of the existing laminate tile flooring with luxury vinyl tile in the preschool rooms, Jungle Safari room, snack shack, break room, Drdak kitchen area, maintenance office, performing arts area and aerobics area.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirement: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable, and accept the proposal from HTC Commercial Flooring in an amount not to exceed $40,000.00 for the replacement of the existing laminate tile flooring with luxury vinyl tile in the preschool rooms, Jungle Safari room, snack shack, break room, Drdak kitchen area, maintenance office, performing arts area and aerobics area, subject to the finalization of the same, preparation of a contract acceptable to the Village, and to the final review and approval thereof by the Village Manager and Village Attorney.
Section 3: That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
Section 4: Repealer: All other Resolutions or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
Section 5: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, or void, the same shall not affect the validity of enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions or sections thereof.
Section 6: Effective Date: This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
