An Ordinance Amending Section 81.10 of the Village Code of Ordinances-Towing Fees

WHEREAS, the Village of Romeoville has adopted certain ordinances now codified as and for Chapter 81 of the Village Code of Ordinances setting forth and establishing certain regulations regarding the towing of motor vehicles within the Village limits, including the fees permitted to be charged by towing companies participating in the rotation tow program established by said Chapter 81; and
WHEREAS, after Village staff review, it has been determined that it is in the best interest of the Village to amend Chapter 81.10 of the Village Code of Ordinances to revise the fees permitted to be charged by towing companies participating in the rotation tow program, and specifically to revise the fee for storage of vehicles towed as light duty tows.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: AMENDMENT OF CHAPTER 81.10 OF THE VILLAGE CODE OF ORDINANCES. All those heretofore adopted ordinances of the Village of Romeoville codified as and for Chapter 81.10(A) of the Village Code of Ordinances are hereby amended to read as hereinafter set forth:
81.10 FEES.
(A) The following schedule of maximum fees shall be in effect for all tows received off the rotation tow list:

Village vehicle tows Light duty tows: First tow of any disabled/inoperable Village owned vehicle to Public Works from any location within 20 miles of the Village Hall is at no charge to the Village; if tow is from father than 20 miles from Village Hall, a mileage charge of $3.00 per mile for each mile over 20 shall apply. For the second and any subsequent tows of the disabled/inoperable Village vehicle, a fee of $75.00 shall apply for tows to locations within 20 miles of the Village Hall; if tow is from father than 20 miles from Village Hall, a mileage charge of $3.00 per mile for each mile over 20 shall apply in addition to the $75.00 fee.
Medium/Heavy duty tows: First tow of any disabled/inoperable Village owned vehicle to Public Works from any location within 20 miles of the Village Hall is at no charge to the Village. If tow is further than 20 miles from Village Hall, a fee of $75.00 per hour shall apply for medium duty tows, and a fee of $100.00 per hour shall apply for heavy duty tows. For the second and any subsequent tow of the disabled/inoperable Village vehicle, a fee of $75.00 per hour shall apply for medium duty tows, and a fee of $100.00 per hour shall apply for heavy duty tows.
In lieu of charging and accepting the fees set forth above for the towing of Village vehicles where a fee would be applicable, a tow operator may instead elect to submit its claim for services rendered to any relevant insurer under any policy of insurance to pay claims pertaining to the condition of the Village vehicles at issue.
Abandoned vehicle tows The otherwise applicable fees and charges quoted above shall apply to tows of abandoned vehicles. The Police Department’s intent is to primarily call for tows of abandoned vehicles during daytime hours, but reserves the right to call for towing of abandoned vehicles on a twenty four hour a day basis.
Tows of vehicles from marked construction The otherwise applicable fees and charges
Zones quoted above shall apply to tows of abandoned vehicles. The Police Department’s intent is to tow vehicles illegally parked in construction zones. The street or construction zone must be posted in advance with no parking/construction zone signage in advance, and/or appropriate advance notice must otherwise be provided to affected residents and property owners. These vehicles shall be towed to a tow operator’s impound lot, and the Police Department will document these tows with a tow report. However, these vehicles shall not be subject to the administrative fee provided for in Chapter 81.251 of this Code.
Tows of vehicles from emergency response It is the Police Department’s intent to tow
sites vehicles as and when necessary to permit emergency repairs to public infrastructure, or to permit emergency response services to be provided by the Police Department, Fire Department or other relevant agencies. In such situations, the Police Department will authorize tow operators to relocate obstructing vehicles to a nearby location as directed and determined by the Police Department. The fee for such tows shall be $100.00, and the Village shall be responsible for the payment of the fee.
Tows of hazardous vehicles The otherwise applicable fees and charges quoted above shall apply to tows of hazardous vehicles.
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
