A Resolution to Accept a Bid from The Kenneth Company
to Install a Playground at Discovery Park

WHEREAS, the Village of Romeoville ("Village") has heretofore received three bids to install a playground at Discovery Park from The Kenneth Company for $140,403.00; a bid from Clauss Brothers, Inc. for $162,922.55; and a bid from George's Landscaping, Inc. for $174,500.00; and
WHEREAS, the Village would like to accept the proposal from The Kenneth Company to install a playground at Discovery Park for $140,403.00 (see Exhibit A), which was the lower bid; and
WHEREAS, the Village would further like to include necessary costs for the new playground: playground equipment from Play Illinois, LLC/Burke for $90,974.00; by owner items such as trash receptacles, bike racks, and bench for $5,750.00 (see Exhibit B); and contingency/design fee of $3,510.00; and
WHEREAS, the Village has been provided a rendering of the proposed renovations for the new playground at Discovery Park (see Exhibit C); and
WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
WHEREAS, to permit the prompt commencement and completion of the aforementioned project, the Village must execute a contract with The Kenneth Company for the performance of such work.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
SECTION ONE: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth in this Section 1.
SECTION TWO: That the various provisions of this Resolutions are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not be affect the validity of the ...
