An Ordinance Amending Section 74.02(A)(2) of the Village Code of Ordinances-Mailbox Parking Regulations

WHEREAS, the Village has adopted certain ordinances now codified as and for Section 74.02(A)(2) of the Village Code of Ordinances, pertaining to parking regulation; and

 

                     WHEREAS, after Village staff review, it has been determined that it is in the best interest of the Village to amend said Section 74.02(A)(2) of the Village Code of Ordinances as hereinafter set forth.

 

                     NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

 

                     SECTION 1:  RECITALS.  The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

                     SECTION 2:  AMENDMENT TO SECTION 74.02(A)(2) OF THE VILLAGE CODE OF ORDINANCES.  That all those heretofore adopted ordinances of the Village codified as and for Section 74.02(A)(2)(g) of the Village Code of Ordinances shall hereby be revised to read as hereinafter set forth, and further than a new Section 74.02(A)(2)(h) shall be added, to read as hereinafter set forth below:

(g)   Within 15 feet of a curbside cluster mailbox between the hours of 9:00 a.m. to 5:00 p.m., Monday through Saturday.  As used herein the term "CURBSIDE CLUSTER MAILBOX" means and includes any box or receptacle held out or intended to receive deliveries of U.S. mail that contains two or more separate areas for the receipt of U.S. mail to separate addresses, including but not limited to an assemblage of two or more individual mailboxes placed closely together in a manner reasonably intended to facilitate delivery of U.S. mail.

 

(h)  Within 15 feet of any single curbside mailbox belonging to another between the hours of 9:00 a.m. and 5:00 p.m. Monday through Saturday. A violation is presumed to be present if the registration address of any vehicle parking within such 15 foot area does not match the address of the mailbox within such 15 foot area, or if the officer obtains reliable information from another source that the parked vehicle has no relation to the address of the mailbox within such 15 foot area.

 

SECTION 3:  SEVERABILITY.  That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 4:  CONFLICTS.  All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency. 

 

                     SECTION 5: EFFECTIVE DATE.  This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
