A Resolution Authorizing the Waiving of the Bids for the Acceptance of a Proposal from Able Masonry Development Inc. for Improvements to the Renwick/Weber Road Sign

WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of its Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies,
WHEREAS, the Village of Romeoville has received a proposal from Able Masonry Development Inc. for the installation of limestone material at the Village entry sign located at the northwest corner of Renwick Road and Weber Road, a copy of which is attached hereto and incorporated herein as Exhibit A; and
WHEREAS, the limestone material to be installed per the proposal has been donated to the Village for the project by Gary Galassi of Galassi Stone and Steel; and
WHEREAS, based upon review of the proposal and the proposed contractor qualifications, the Village has determined to accept the proposal from Able Masonry Development, Inc. attached hereto and incorporated herein as Exhibit A, upon and subject to the conditions that the total cost to the Village for the work referenced in such proposal shall not exceed the sum of $65,000.00, and to the memorialization of the same in a written contract acceptable to the parties.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS
5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable to the installation of limestone material at the Village entry sign located at the northwest corner of Renwick Road and Weber Road, and accept the proposal from Able Masonry Development, Inc. attached hereto and incorporated herein as Exhibit A, upon and subject to the conditions that the total cost to the Village for the work referenced in such proposal shall not exceed the sum of $65,000.00, and to the memorialization of the same in a written contract acceptable to the parties, and further authorize the execution of any purchase orders and other documents as may reasonably be required in connection therewith.
Section 3: Repealer: All other Resolutions or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions, or sections thereof.
Section 5: Effective Date: The Ordinance shall take effect after its passage, approval, and publication in pamphlet form, as regulated by law.
