A Resolution Authorizing the Execution of a Lease Agreement with Vertical Bridge Development LLC (27 Montrose Drive)

WHEREAS, the Village of Romeoville desires to enter into a Lease Agreement with Vertical Bridge Development LLC (“Tenant”) for premises at or near 27 Montrose Drive, Romeoville, Illinois; and

 

                     WHEREAS, under the contemplated Lease Agreement, Tenant proposes to construct a wireless communications tower, a portion of which shall be available to the Village for the installation of its own wireless communication for emergency response purposes; and

 

                     WHEREAS, it is in the best interests of the Village to enter into such a lease in substantially the form attached hereto and incorporated herein by reference as Exhibit A, so as to facilitate and enhance the Village’s emergency response communications capabilities.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

 

                     SECTION ONE.  The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

 

                     SECTION TWO.   The Village President is hereby authorized to execute a Lease Agreement in substantially the form shown in Exhibit A for certain premises located, Romeoville, Illinois, subject to the final review and approval of the said lease and exhibits thereto by the Village Manager and the Village Attorney.

 

SECTION THREE.  That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

                     SECTION FOUR.  All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency. 

 

                     SECTION FIVE.  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
