A Resolution to Accept a Proposal from NuToys Leisure Products
for Playground Equipment for the Budler Park Renovation

WHEREAS, pursuant to the provisions of 65 ILCS 5/9-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of the Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and
WHEREAS, the Village of Romeoville approved a resolution to renovate Budler Park on December 19. 2018, and
WHEREAS, the Village of Romeoville (“Village”) has heretofore received a proposal from NuToys Leisure Products for playground equipment for the renovation at Budler Park in the amount of $62,000.00 (see Exhibit A); and
WHEREAS, the Village has been provided a rendering of the proposed renovations for Budler Park (see Exhibit B); and
WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
WHEREAS, to permit the prompt commencement and completion of the aforementioned project, the Village must approve a proposal from NuToys Leisure Products for playground equipment to complete the renovation.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
SECTION ONE: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth in this Section 1.
SECTION TWO: That the various provisions of this Resolutions are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not be affect the validity of the remaining provisions of this Resolution.
SECTION THREE: All prior Resolutions or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION FOUR: This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet for as provided by law.
SECTION FIVE: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to this project.
SECTION SIX: The Village hereby authorizes the acceptance of the proposal from NuToys Leisure Products for playground equipment necessary for the renovations at Budler Park for a total of $62,000.00, and the acceptance of the proposal for such work as referenced thereon, subject to final Village Manager and Village Attorney review.
