An Ordinance Proposing the Creation of a Business District in The Village of Romeoville, Will County, Illinois, and Providing For A Public Hearing In Connection With the Proposed Business District (“Normantown Road Business District No. 1”)

WHEREAS, Section 11-74.3-1(1) of the Illinois Business District Development and Redevelopment Law, 65 ILCS 5/11-74.3-1, et seq. (the "Law") allows a municipality to determine that it is "essential to the economic and social welfare of the municipality that business districts be developed, redeveloped, improved, maintained, and revitalized, that jobs and opportunity for employment be created within the municipality, and that, if blighting conditions are present, blighting conditions be eradicated by assuring opportunities for development or redevelopment, encouraging private investment, and attracting sound and stable business and commercial growth;" and

                     WHEREAS, it is in the public interest that the area depicted in the map in EXHIBIT A, attached hereto and legally described on Exhibit B attached hereto and made a part hereof (the proposed “Normantown Road Business District No. 1"), in the Village of Romeoville, Will County, Illinois (the “Village”), be considered for designation as a “business district” pursuant to the Law; and

                     WHEREAS, a Business District Plan has been prepared with respect to the proposed Normantown Road Business District No. 1; and

                     WHEREAS, the proposed Normantown Road Business District No. 1 is situated within the corporate limits of the Village; and

                     NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Romeoville, Will County, Illinois in the exercise of their statutory, home-rule and other authority, as follows:

                     SECTION 1:  That the preambles of this ordinance are hereby incorporated as though fully set forth herein.

                     SECTION 2:  That a public hearing shall be held at the regularly scheduled meeting of the Village Board on December 19, 2018, at 6:00 pm at the Romeoville Village Hall, 1050 West Romeo Road, Romeoville, Illinois (the "Hearing"), to consider whether to approve a Business District Plan for the Normantown Road Business District No. 1, and whether to designate the Normantown Road Business District No. 1 as a business district, each as provided by the Law.

                     SECTION 3:  That notice of the Hearing shall be given by publication at least twice, not more than thirty (30) nor less than ten (10) days prior to the Hearing, in a newspaper in general circulation in the Village, in substantially the same form as in EXHIBIT C attached hereto and made a part hereof.

                     SECTION 4:   REPEALER   That all ordinances, orders and resolutions and parts thereof in conflict herewith shall be and the same are hereby repealed, and that this ordinance shall be in full force and effect forthwith upon its adoption and approval.

                     SECTION 5:  EFFECTIVE DATE  This Ordinance shall be in full force and effect from and after its adoption and approval as provided by law.

SECTION 6:  SEVERABILITY   This Ordinance and every provision thereof, shall be considered severable.  In the event that any court of competent jurisdiction may find and declare any word, phrase, clause, sentence, paragraph, provision or section or part of a phrase, clause, sentence, paragraph, provision or section of this Ordinance is void or unconstitutional, the remaining words, phrases, clauses, sentences, paragraphs and provisions and parts of phrases, clauses, sentences, paragraphs, provisions and sections not ruled void or unconstitutional shall continue in full force and effect.
