Title

An Ordinance Establishing a Temporary Suspension of Certain Signage Regulations and Fees in Connection with the Weber Road/I-55 Interchange Project

Body

 

                     

                     WHEREAS, the Village of Romeoville, (hereinafter “Village”), has the authority to adopt ordinances pertaining to the public health, safety and welfare regulating private and public property; and

 

                     WHEREAS, in conformance with said authority, the Village has from time to time adopted provisions of Chapter 159 of its Code of Ordinances pertaining to the regulation of signage within the Village and the fees to be imposed in connection with various sign permit applications and approvals; and

 

                     WHEREAS, the Village has been advised of the recent commencement of construction activity for the new Weber Road/I-55 Interchange; and

 

                     WHEREAS, the interchange construction project will extend for a period of multiple years, and will require the removal and relocation of a significant number of existing signs presently owned and used within the Weber Road corridor; and

 

                     WHEREAS, to assist the businesses and property owners who have been or will be required to relocate or remove existing signage in connection with the interchange construction project, the Village has determined that it is appropriate to temporarily suspend application/permit fees for temporary sign permits and to temporarily suspend the time limits otherwise applicable to the placement and use of temporary signage, subject to the conditions hereinafter set forth; and

 

                     WHEREAS, to further assist the businesses and property owners who have been or will be required to relocate or remove existing signage in connection with the interchange construction project, the Village has additionally determined that it is appropriate to temporarily suspend the otherwise applicable prohibition on the placement of temporary signage on an offsite property other than the property to which the signage pertains, subject to the conditions hereinafter set forth.

 

 

                     NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; that

 

 

                     SECTION 1:  RECITALS - The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

 

SECTION 2:  SUSPENSION OF TEMPORARY SIGN APPLICATION/PERMIT FEES.  Notwithstanding any other contrary provision of the Village Code of Ordinances, the Village hereby temporarily suspends the imposition of the application/permit fees otherwise applicable to the issuance of permits for the placement and use of temporary signage.

 

SECTION 3: SUSPENSION OF TEMPORARY SIGN TIME LIMITS.  Notwithstanding any other contrary provision of the Village Code of Ordinances, the Village hereby temporarily suspends the application of any maximum time limits for the placement and use of temporary signage otherwise provided for by the applicable provisions of the Village Code of Ordinances.

 

SECTION 4:  SUSPENSION OF PROHIBITION OF OFFSITE PLACEMENT OF TEMPORARY SIGNS.  Notwithstanding any other contrary provision of the Village Code of Ordinances, the Village hereby temporarily suspends the application of any prohibition otherwise set forth in the Village Code of Ordinances to the placement of temporary signage on offsite properties other than the property to which the signage pertains, provided, however, that no such temporary signage shall be placed in any offsite location without the written consent of the owner of the property proposed as the location for the temporary signage in question.

 

SECTION 5:  DURATION AND SCOPE OF TEMPORARY SUSPENSIONS.  The temporary suspension of the application of the provisions of the Village Code of Ordinances as hereinabove described shall take effect from and after the effective date of this Ordinance, and shall last until such time as the Village Manager, in his discretion, determines in writing that the Weber Road and I-55 Interchange project has been substantially completed.  The temporary suspensions hereinabove described shall only be applicable to temporary signage sought to be used or placed by owners or users of property located generally within the Weber Road corridor that have reasonably been determined by the Village to have been materially affected by the construction of the Weber Road and I-55 Interchange project.  Except as expressly provided for herein, all temporary signage subject to the temporary suspension of certain provisions of the Village Code of Ordinances as hereinabove described shall otherwise fully comply with all other applicable provisions of the Village Code of Ordinances not so temporarily suspended.

 

SECTION 6:                     SEVERABILITY - That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 7:  CONFLICTS - All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

                     SECTION 8:  REPEALER - All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance shall be, and the same are hereby repealed.

 

                     SECTION 9: EFFECTIVE DATE - This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
