A Resolution Authorizing the Waiving of Bids for the Provision of Tree Planting Services for the Village Tree Replacement Program and for the Purchase of Trees through such program

WHEREAS, pursuant to a two-thirds vote of the Village Board of Trustees, the Board may waive the requirements of the Village Code of Ordinances and the Illinois Municipal Code to competitively bid certain contracts for the procurement of goods and services or performance of certain work; and
WHEREAS, Village of Romeoville has requested proposals for the provision of a Tree replacement services under the Village Tree Replacement Program for a term of one year; and
WHEREAS, based upon review of the applicable proposals, the Village has determined to enter into a contract with low proposal received from J. Hassert Landscaping for the provision of tree replacement services under the Village Tree Replacement Program a term of one year, all upon the terms and conditions set forth in the proposal submitted to the Village by J. Hassert Landscaping attached hereto and incorporated as Exhibit A.; and
WHEREAS, the Village has identified several trees along roadways throughout the Village that are in need of replacement; and
WHEREAS, it is in the best interest of the Village to utilize the Parkway tree program for the replacement of such trees.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
SECTION ONE. The forgoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.
SECTION TWO. The competitive bidding process of the Village of Romeoville Code of Ordinances and the Illinois Municipal Code is hereby waived, and the Village President and Village Clerk of the Village are hereby authorized and directed to execute an agreement with J. Hassert Landscaping in conjunction with the services and provision of the proposal from J. Hassert Landscaping set forth in Exhibit A.
SECTION THREE. Staff is hereby authorized to purchase trees in an amount not to exceed $50,000 for the purpose of replacing trees along major roadways. The cost of these trees are the full responsibility of the Village
SECTION FOUR. All prior Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION FIVE. This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
