An Ordinance Creating Chapter 121A-Home Kitchen and Cottage Food Operations

WHEREAS, after Village staff review, it has been determined that it is in the best interest of the Village to adopt an ordinance permitting Home Kitchen and Cottage Food Operations as authorized by the Food Handling Regulation Enforcement Act, 410 ILCS 625/1 et. seq., as amended; and; and

WHEREAS, the Village Board, after careful and due deliberation, has concluded that the adoption of such an ordinance shall be codified as and for a new Chapter 121A of the Village Code of Ordinances.

NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: The Village of Romeoville Code of Ordinances is hereby amended by adopting a new Chapter 121A- Home Kitchen and Cottage Food Operations, as hereinafter set forth below:

121A.01-Adoption of Food Handling Regulation Enforcement Act
(A) The Village of Romeoville hereby adopts and incorporates the provisions of the Food Handling Regulation Enforcement Act (410 ILCS 625/1 et seq.), as amended.
(B) Home kitchen operations and cottage food operations, as defined by the Food Handling Regulation Enforcement Act, as amended, are permitted within the Village of Romeoville. The sale of non-potentially hazardous food by home kitchen operations and by cottage food operations is also permitted in accordance with the Food Handling Regulation Enforcement Act.
(C) The Village of Romeoville hereby authorizes the direct sale of baked goods as described in Section 4 of the Food Handling Regulation Enforcement Act.
(D) Violations of this Chapter shall be subject to the general penalty provisions of Section 10.99 of this Code. In addition, the Village shall be entitled to ...
