A Resolution Authorizing the Waiving of the Bids for and Ratifying the Purchase of Lighting for Discovery Park from Musco Lighting

WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of the Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and

 

WHEREAS, the Village has heretofore approved a contract with J. Russ & Company, Inc. to provide construction services for the completion of the Phase I and Phase II Improvements to Discovery Park pursuant to Resolution 17-2297, and has likewise heretofore approved a change order to the aforesaid contract to permit the construction of certain additional amenities to Discovery Park, including but not limited to outdoor sports lighting pursuant to Resolution 17-2351; and

 

WHEREAS, while the provisions of Resolution 17-2351 authorized the expenditure of funds not to exceed the amount of $298,000 for the purchase of outdoor sports lighting for Discovery Park, the change order inadvertently omitted reference to the specific vendor, Musco Lighting; and

 

WHEREAS, the outdoor sports lighting has been delivered to the Village by Musco Lighting, installed and placed into service by J. Russ & Company, Inc. pursuant to the change order approved by Resolution 17-2351, and paid for by the Village; and

 

WHEREAS, it is in the best interests of the Village to authorize the waiving of the bods for the purchase of the outdoor sports lighting for Discovery Park from Musco Lighting in an amount not to exceed $298,000, and to ratify all actions taken by Village staff in connection with the procurement of and payment for the outdoor sports lighting at Discovery Park.

 

 

NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:

 

Section 1:                     Incorporation of Recitals:  The foregoing recitals are hereby expressly incorporated into and made part of this Resolution as if fully set forth herein.

 

Section 2:                     Waiver of Public Bid Requirement: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable to the procurement of and payment for the outdoor sports lighting supplied to the Village by Musco Lighting, per the proposal therefor heretofore provided to the Village, and in an amount not to exceed $298,000.00.

 

Section 3:                     Ratification of Purchase and Payment:  The Village hereby ratifies all actions heretofore taken by all Village personnel in connection with the procurement of and payment for the Discovery Park outdoor sports lighting from Musco Lighting as hereinabove set forth.

 

Section 4:                     Severability:  That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

Section 5:                     Repealer:  All other Resolutions or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

Section 6:                     Effective Date:  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
