An Ordinance Creating Chapter 56-Small Wireless Facilities--of the Village Code of Ordinances

WHEREAS, the Illinois General Assembly has recently enacted Public Act 100-0585, known as the Small Wireless Facilities Deployment Act (the Act), which becomes effective on June 1, 2018; and
WHEREAS, the Village of Romeoville (the Village) is an Illinois municipality in accordance with the Constitution of the State of Illinois of 1970; and
WHEREAS, the Village is authorized, under existing State and federal law, to enact appropriate regulations and restrictions relative to small wireless facilities, distributed antenna systems and other personal wireless telecommunication facility installations in the public right-of-way as long as it does not conflict with State and federal law; and
WHEREAS, the Act sets forth the requirements for the collocation of small wireless facilities by local authorities.
NOW, THEREFORE, be it ordained by the corporate authorities of the Village of Romeoville as follows:

SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: ADOPTION OF CHAPTER 56. The Village of Romeoville Code of Ordinances is hereby amended by adopting a new Chapter 56-Small Wireless Facilities which is attached hereto as Exhibit A, and incorporated herein by this reference.
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
