A Resolution Authorizing the Execution of a Storm Sewer, Roadway and Watermain Easement Agreement with Commonwealth Edison Company, Abbott Land Gateway LLC, and the Romeoville Gateway Association

WHEREAS, the Village of Romeoville desires to enter into a Storm Sewer, Roadway and Watermain Easement Agreement in the form attached hereto and incorporated herein as Exhibit A with Commonwealth Edison Company, Abbott Land Gateway LLC, and the Romeoville Gateway Association to facilitate the construction of storm sewer, roadway and watermain improvements in connection with the development of the Gateway business park at Route 53 and Joliet Road.


NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

SECTION ONE. The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

SECTION TWO. That the proper officers and personnel of the Village are hereby authorized and directed to sign the Storm Sewer, Roadway and Watermain Easement Agreement in the form attached hereto and incorporated herein as Exhibit A with Commonwealth Edison Company, Abbott Land Gateway LLC, and the Romeoville Gateway Association, provided, however, that the approvals contained herein are subject to the Village's review and approval of the recorded declaration of covenants, conditions and restrictions covering the Gateway business park as the same pertains to the indemnification of the Village of Romeoville for, of and from its obligations under the provisions of the aforesaid easement agreement.

SECTION THREE. That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
