A Resolution Waiving the Public Bidding Process and
Authorizing a Contract with CDW for

Microsoft Licensing

                     WHEREAS, pursuant to a two-thirds vote of the Village Board of Trustees, the Board may waive the requirements of the Village Code of Ordinances and the Illinois Municipal Code to competitively bid certain contracts for the procurement of goods and services or performance of certain work; and

 

WHEREAS, Village of Romeoville desires to enter into that certain agreement for

Licensing of Microsoft Products; and

 

WHEREAS, Staff has received two proposals for such licensing and recommending the low proposal from CDW.

 

                     NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

 

                     SECTION ONE.  The forgoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

 

                     SECTION TWO.   The competitive bidding process of the Village of Romeoville Code of Ordinances and the Illinois Municipal Code is hereby waived, and the Village President and Deputy Village Clerk of the Village are hereby authorized and directed to execute an agreement with CDW for Microsoft Licensing all in substantially the form attached hereto and incorporated herein as Exhibit A.

 

                     

 

SECTION THREE.  That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

                     SECTION FOUR.  All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

                     SECTION FIVE.  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
