An Ordinance Amending Chapter 159.073(B)(3) (B-3 Permitted Uses)

WHEREAS, periodic staff review of the provisions of Chapter 159.073(B) setting forth the permitted uses within the B-3 Zoning District has indicated the need for potential revision to the same to provide for additional food truck operating locations within the Village, all as more fully hereinafter set forth; and

WHEREAS, a public hearing on the above-contemplated amendment to the text of the Village Zoning Code has been conducted before the Village Plan Commission, and the same has otherwise been reviewed and considered in accordance with the applicable provisions of the Village of Romeoville Code of Ordinances and the laws of the State of Illinois.

NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

SECTION 2: AMENDMENT TO CHAPTER 159.073(B). All those heretofore adopted Village Ordinances codified as and for Chapter 159.073(B) shall hereby be amended by the addition of the following text, to be codified as and for a new Chapter 159.073(B)(19):

(19) Food truck or food truck operator, subject to the requirements of Chapter 129 (Food Trucks and Food Truck Operators), but only when the food truck in question is operated in connection with the operation of an establishment licensed to serve alcoholic beverages for on premises consumption through a duly issued Class M-1 or Class O liquor license issued by the Local Liquor Control Commissioner in accordance with the provisions of Chapter 112 of the Village Code of Ordinances.



SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validi...
