A Resolution Authorizing an Amendment to an Intergovernmental Agreement with the Villages of Bolingbrook and Plainfield (Engineering Cost Sharing for Phase I Engineering for I-55 Interchanges at Illinois Route 126 and Airport Road)

WHEREAS, the Village of Romeoville has by Resolution No. 09-1195 approved an Intergovernmental Agreement ("Agreement") with the Village of Bolingbrook pertaining to the funding and completion of Phase I Engineering for proposed interchange improvements at Route 126 and Airport Road, and has approved an amendment thereto with the Village of Bolingbrook and the Village of Plainfield by Resolution 11-1429; and
WHEREAS, the parties desire to amend the Agreement, as previously amended, upon the terms set forth in the proposed amendment to the Agreement attached hereto and incorporated herein as Exhibit A ("Amendment") and the Villages of Plainfield, Romeoville and Bolingbrook are amenable thereto; and
WHEREAS, municipalities are authorized to enter into Intergovernmental Agreements to combine, share, or jointly exercise their respective powers and authorities in any manner not otherwise prohibited by law and pursuant to Article 7, Section 10 of the Illinois Constitution of 1970 and the Intergovernmental Cooperation Act, 5 ILCS 220/1 et. seq.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
SECTION ONE. The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.
SECTION TWO. That the Village President is hereby authorized and directed to execute an amendment in substantially the form set forth in Exhibit A and the Village Clerk is authorized and directed to attest thereto, subject to final approval of any language changes by the Village Manager and Village Attorney.
