A Resolution Authorizing the Execution of a Lease Amendment with PDV Midwest Refining LLC (Temporary Construction Easements/Grading)

WHEREAS, the Village of Romeoville desires to amend an existing lease with PDV Midwest Refining LLC approved on February 19, 2014, to allow the Village to perform certain roadway construction and allow the Village to perform additional grading work in connection therewith, in the form attached as Exhibit A; and
WHEREAS, investigation by the Village of Romeoville has determined that the granting of these additional easements is necessary in order to complete roadway improvements serving the leased property, the site of the Metra commuter rail station and parking lot.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Authorization of Lease Amendment: That the Village President is hereby authorized and directed to execute a lease amendment to an existing lease with PDV Midwest Refining, LLC, in the form attached hereto as Exhibit A
Section 3: Repealer: All other Resolutions of the Village of Romeoville that are inconsistent herewith are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions, or sections thereof.
Section 5: Effective Date: This resolution shall take effect after its passage, approval, and publication in pamphlet form, as regulated by law.
