A Resolution Authorizing the Amendment of a Contract for the Provision of Collection and Cost Recovery Services (Fire Recovery USA, LLC)

WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of its Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies,
WHEREAS, the Village of Romeoville desires to amend an existing contract with Fire Recovery USA, LLC approved on December 3, 2014 and as subsequently amended for the collection of various unpaid fees and costs owed to the Village of Romeoville for any and all hazmat services provided by the Romeoville Fire Department; and
WHEREAS, investigation by the Village of Romeoville has determined that Fire Recovery USA, LLC is providing satisfactory service under the existing contract approved on December 3, 2014 and as subsequently amended, and that Fire Recovery USA, LLC is ready, willing and able to provide the collection and cost hazmat recovery services desired by the Village.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS
5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable to the purchase and receipt of collection and cost recovery services from Fire Recovery USA, LLC as it pertains to hazmat services, and authorize an amendment to the existing contract approved on December 3, 2014, as subsequently amended, all in the form set forth in Exhibit A to this Resolution (a copy of which is attached hereto and incorporated herein by reference), and authorize the execution of the same by the proper officers of the Village.
Section 3: Repealer: All other Resolutions or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions, or sections thereof.
Section 5: Effective Date: The Ordinance shall take effect after its passage, approval, and publication in pamphlet form, as regulated by law.
