A Resolution Authorizing An Amendment to An Existing License for Real Property (U.S. Army Corps of Engineers-Grounding System, Covers, Warning Signage and Grounding Mesh-135th Street Bridge)

 

 

                     Body

WHEREAS, the U.S. Army Corps of Engineers has in 2012 obtained a license from the Village of Romeoville to install grounding equipment on Piers 1 through 6 of the 135th Street Bridge to minimize the pickup and discharge of stray electrical current from the operation of the fish barrier between the soil adjacent to the bridge piers and the rebar contained within the bridge piers; and

 

                     WHEREAS, the U.S. Army Corps of Engineers has requested an amendment to the license obtained in 2012 to permit the installation of warning signs, coverings and grounding systems to mitigate the effects of stray electric current that has and continues to migrate from the fish barrier into surrounding areas, including but not limited to light poles and railings on the 135th Street Bridge.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

 

                     SECTION ONE.  The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

 

                     SECTION TWO.   The Village President is hereby authorized to execute an amendment to the 2012 license with the U.S. Army Corps of Engineers in substantially the form shown as Exhibit A hereto.

 

SECTION THREE.  That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

                     SECTION FOUR.  All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

                     SECTION FIVE.  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
