Title

A RESOLUTION AUTHORIZING THE EXECUTION OF A PARTIAL RELEASE OF EASEMENT (Windham Lakes Business Park-Northeast corner of Weber Road and Remington Boulevard)

 

                     Body

WHEREAS, the Village of Romeoville has certain signage and landscaping rights under an easement agreement recorded as Document No. R2004180653 with the Will County Recorder’s Office; and

 

                     WHEREAS, in connection with the ongoing IDOT project to reconstruct the interchange at Weber Road and I-55, IDOT has requested the Village to release the aforesaid easement with respect to a portion of the property subject thereto, in substantially the form attached hereto and incorporated herein as Exhibit A; and

 

                     WHEREAS, the Village has determined that it is in the best interests of the Village to approve the easement release attached hereto as Exhibit A, subject to the payment to and receipt by the Village of compensation for the loss of landscaping contained within the easement release area; and

 

                     WHEREAS, the Village is authorized to approve this instrument in the exercise of its powers of intergovernmental cooperation as authorized by Article 7, Section 10 of the Illinois Constitution of 1970 and the Intergovernmental Cooperation Act, 5 ILCS 220/1 et. seq.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

 

                     SECTION ONE.  The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

 

                     SECTION TWO.   The Village President and Clerk are hereby authorized to execute and attest to the execution of an easement release in substantially the form attached hereto as Exhibit A, subject to the Village’s receipt of compensation in the amount of $8,000.00 for the landscaping lost in the area subject to the release, or upon the presentation of documentation satisfactory to the Village evidencing the payment of such compensation.

 

SECTION THREE.  That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

                     SECTION FOUR.  All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

                     SECTION FIVE.  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
