A RESOLUTION APPROVING A SALES TAX SHARING AND DEVELOPMENT AGREEMENT (METAL MONKEY BREWING, LLC)

WHEREAS, the Village of Romeoville is an Illinois home rule municipality under the provisions of the Illinois Constitution of 1970; and
WHEREAS, the provisions of 65 ILCS 5/8-11-20 authorize the Village to enter into sales tax and development agreements upon the making of certain findings as set forth therein; and
WHEREAS, the Village of Romeoville has received a request from Metal Monkey Brewing LLC to enter into a sales tax sharing and development agreement, and the Corporate Authorities of the Village find that the requested agreement satisfies the requirements of 65 ILCS 5/8-11-20; and
WHEREAS, the Village of Romeoville has determined that it is in the best interests of the Village to enter into a sales tax sharing and development agreement in substantially the form attached hereto as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
SECTION ONE. The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.
SECTION TWO. The President and Clerk are hereby authorized to execute and attest to the execution of a sales tax sharing and development agreement with Metal Monkey Brewing, LLC in substantially the form attached hereto as Exhibit A.
SECTION THREE. That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
SECTION FOUR. All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
