An Ordinance Amending Section 56.03 of the Village Code of Ordinances

WHEREAS, after Village staff review, it has been determined that it is in the best interest of the Village to adopt revisions to Section 56.03(B)(2)(b) of the Village Code of Ordinances to amend and clarify certain requirements for the installation and collocation of small wireless facilities on Village utility poles within Village rights of way.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: AMENDMENT TO SECTION 56.03(B)(2)(b) OF THE VILLAGE CODE OF ORDINANCES. All those heretofore adopted ordinances of the Village of Romeoville codified as and for Section 56.03(B)(2)(b) of the Village Code of Ordinances shall hereby be amended by the addition of the following text, to be codified as and for a new Section 56.03(B)(2)(b)(6):
(6) Pole attachment permit/agreement waiver. In circumstances where the Director of Public Works reasonably determines that the pole attachment permit applicant will not require collocation of small wireless facilities on all or on a substantial proportion of all Village utility poles, or will only require isolated or infrequent collocation, the Director shall be authorized to approve the collocation of an applicant's small wireless facilities on Village utility poles by the issuance of a permit, in such form as the Village shall from time to time employ, provided, however, that such permit shall in all events be conditioned upon ongoing compliance with the provisions of this Chapter 56, the provisions of the Act, the provisions of Chapter 55 and 150 of the Village Code of Ordinances (subject to the application of Section 56.12 of this Chapter) and the provisions of the then-current Village pole attachment agreement in use from time to time...
