A Resolution Approving a Plat of Vacation of Watermain Easement (JRPD Watermain Relocation)

WHEREAS, the Village of Romeoville has previously relocated a certain watermain running through Joliet Regional Port District property to a new easement in order to facilitate the construction of the newly completed control tower, and in connection therewith, now desires to vacate the prior and unused water main easement from the original water main location; and

WHEREAS, the plat prepared attached hereto and incorporated herein by reference as Exhibit A depicts the vacation of the prior existing watermain easement; and

WHEREAS, the Village of Romeoville has determined that it is in its best interests to approve the plat of vacation of watermain easement, all in the form attached hereto as Exhibit A.

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

SECTION ONE. The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

SECTION TWO. That the proper officers of the Village are authorized and directed to execute and attest to the execution of the plat of vacation of watermain easement attached hereto as Exhibit A, subject to final Village Manager and Village Attorney review, and to thereafter cause the same to be recorded.

SECTION TWO A. For clarity and the avoidance of doubt, nothing herein shall be deemed to affect or vacate any easement for any other utility other than the watermain easement depicted and referenced in the attached Exhibit A.

SECTION THREE. That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
