A Resolution Authorizing License Agreements (Naperville Drive/Honeytree Subdivision Rear Yard Fence Replacements)

WHEREAS, the Village of Romeoville is an Illinois home rule municipality under the provisions of the Illinois Constitution of 1970; and
WHEREAS, the Village is presently undertaking a program of removing fencing associated with the rear yards of several residences adjacent to Naperville Drive from encroaching onto the Village's Naperville Drive right of way, and replacing the same with rear yard fencing having a uniform appearance at locations within the rear yards of the residences in question, all at the cost and expense of the Village; and
WHEREAS, in order to perform such work, the Village requires appropriate permission to enter the affected properties and to perform the work in question thereon; and
WHEREAS, in order to permit the completion of the above-mentioned project, it is in the best interests of the Village to authorize the Assistant Village Manager to execute license agreements on behalf of the Village with the relevant property owners.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, AND ILLINOIS:
SECTION ONE. The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.
SECTION TWO. The Assistant Village Manager is hereby authorized to execute license agreements in substantially the form attached hereto as Exhibit A with property owners participating in the Naperville Drive/Honeytree Subdivision Rear Yard Fence Replacement Program, subject to final review and approval by the Village Manager and the Village Attorney.
SECTION THREE. That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of...
