A Resolution Authorizing the Execution of a Firework Display Contract with Pyrotecnico Fireworks, Inc.

WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Section 36.42(D) of the Village Code of Ordinances, the Village of Romeoville may by a two-thirds vote of its Trustees then holding office waive the requirements for public bidding on Village public work, or improvement projects, goods or services where otherwise required; and

WHEREAS, the Village of Romeoville has determined that it is in its best interests to authorize the execution of a Firework Display Contract with Pyrotecnico Fireworks, Inc., in substantially the form attached as Exhibit A, and by a two-thirds vote of its Trustees then holding office waive the requirements for public bidding otherwise applicable thereto.

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

SECTION ONE. The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

SECTION TWO. That the Village President is authorized to execute a Laser Show Production Contract with Laser Show, Inc., in substantially the form attached as Exhibit A, subject to final Village Manager and Village Attorney review and approval, and that the requirements for public bidding otherwise applicable thereto are hereby waived pursuant to a two-thirds vote of the Trustees now holding office.

SECTION THREE. That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

SECTION FOUR. All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
