An Ordinance Authorizing the Execution of an Amendment to an Annexation Agreement (NATURAL GAS PIPELINE COMPANY OF AMERICA LLC, a Delaware limited liability corporation)

WHEREAS, NATURAL GAS PIPELINE COMPANY OF AMERICA LLC, a Delaware limited liability corporation ("Owner") and the Village of Romeoville ("Village") have proposed to amend a heretofore approved annexation agreement recorded as Document No. R2017094418 with the Will County Recorder's Office; and
WHEREAS, the statutory procedures provided for by 65 IL CS 5/11-15.1-1 et seq. for the execution of the Amendment to the Annexation Agreement, including requisite notice and hearing requirements, have been fully satisfied; and,
WHEREAS, the corporate authorities of the Village have determined that it is in the best interest of the Village to enter into the Amendment to the Annexation Agreement in the form shown in Exhibit A hereto.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: AUTHORIZATION. The Village President and Village Clerk are hereby authorized and directed to execute and attest to the execution of an amendment to an annexation agreement substantially the form attached as Exhibit A, provided, however, that the authorization and approvals herein contained shall be subject to final review and approval by the Village Manager and the Village Attorney of the Annexation Agreement attached hereto as Exhibit A and of all supporting and ancillary documentation and exhibits related thereto or incorporated therein.
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of th...
