A Resolution to Approve an IEPA's SRF Low Interest Loan Program Notice of Intent to Award Document to Whittaker Construction and Excavating, Inc. for the Wastewater Treatment Facility - Improvements at 7.5 MGD

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, a bid letting for the Wastewater Treatment Facility Improvements was held on Friday May 8, 2026; and,
Whereas, three bids were received with the low bid of $10,120,000.00 being from Whittaker Construction and Excavating, Inc.; and,
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Awarding of Contract: Village staff and their consultants are recommending approving the contract with Whittaker Construction and Excavating as they are substantially in compliance with the bidding documents. The Engineer's Opinion of Probable Cost was $9,800.000.00 and was based on the original loan amount from IEPA. Staff and engineering work diligently on the project scope to target the approved amount. Staff are also recommending approving a 3% contingency of the contract amount for unforeseen circumstances that may arise during this complex project.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitution...
