A Resolution Approving an Intergovernmental Agreement between the Grand Prairie Water Commission and the Village of Romeoville Establishing a Joint Improvement Program

WHEREAS, the Village of Romeoville (the "Village") is a member of the Grand Prairie Water Commission (the "Commission"), together with the City of Joliet, the Village of Channahon, the City of Crest Hill, the Village of Minooka, and the Village of Shorewood; and
WHEREAS, pursuant to Article VII, Section 10 of the Illinois Constitution of 1970 and the Intergovernmental Cooperation Act, 5 ILCS 220, the Village and the Commission have the power to contract or otherwise associate among themselves "to obtain or share services and to exercise, combine or transfer any power or function, in any manner not prohibited by law or by ordinance" as well as to use their revenues, credit and other resources for such activities; and
WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., also authorizes the joint use and enjoyment of the powers, privileges, functions and authority of the Village and the Commission; and
WHEREAS, the Commission and Village have determined that it is necessary and desirable to enter into an intergovernmental agreement (the "Agreement"), a copy of which is attached hereto and incorporated herein as Exhibit A; and
WHEREAS, the Agreement identifies certain projects to be constructed by the Commission (the "Commission Projects") and certain projects to be constructed by the Village (the "Village Projects"); and
WHEREAS, given the nature and proximity of the Commission Projects and the Village Projects, the Commission and Village have determined that it is mutually advantageous to award a single contract for the construction of the Commission Projects and the Village Projects for each pair of Commission and Village Projects as more fully identified in the Agreement; and
