An Ordinance Amending Chapter 39 of the Village Code of Ordinances (Village Policies)

                     WHEREAS, periodic review of the provisions of Chapter 39 (Village Policies) of the Village Code of Ordinances has indicated the need for certain amendments to Chapter 39 to establish a policy.

 

                     NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

 

                     SECTION 1:  RECITALS.  The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

 

                     SECTION 2:  ADOPTION OF CHAPTER 39 AMENDMENTS.  That all heretofore adopted Village Ordinances codified as and for Chapter 39 shall be and hereby are amended by the addition of the text set forth below, to be codified as and for a new Section 39.080:

                     39.080                     Small Business Start Up Grant Policy

                     (A)                     Available Grants

                                          (1)  Matching Funds Grant.  Grants of up to a total of $5,000 will be available from time to time to defray not more than fifty percent of eligible costs as hereinafter defined.

                                          (2)  Fee Waivers.  Recipients of Matching Funds Grants are also eligible to receive waivers of applicable business license fees under Section 43.01(C) of this Code, inspection fees required in connection with occupancy or completion of construction/buildout and building permit fees for permits required for building out or finishing space.

                     (B)                     Eligible Recipients.  In order to be eligible for grants available under this policy as hereinabove described, an applicant/recipient must be a for profit business entity with five or more employees, generating not more than $1,000,000 annually in gross revenues and located in a brick and mortar commercial building physically located within the Village of Romeoville.

                     (C)                     Eligible Costs.  Applicant/recipients must show that they have or will necessarily incur eligible costs for business start up, planning/marketing. Training and technical support, equipment, inventory and supplies and working capital/operating expenses.

                     (D)                     Application Process.  Applicants shall submit grant applications in such form as the Village may from time to time require, with such information and documentation as the Village may from time to time require.  This information shall at a minimum include evidence of the ownership of the applicant business, proof of lease or ownership of the business premises within the Village of Romeoville, a business plan, and a narrative describing the applicant and its business operations.  All applications shall be submitted to the Village Manager for review and evaluation.

                     (E)                     Funds Availability.  Fulfillment of any grant application hereunder shall also be subject to the availability of funds budgeted or otherwise made available by the Village for this program, and the Village shall have no obligation not fund any grant application at any time when funds appropriated, budgeted or otherwise available to this program have been exhausted.

                     (F)                     Village Manager Oversight.  The Village Manger shall be authorized from time to time to adjust the parameters of the policy as herein set forth, to suspend or modify the policy, and to otherwise flexibly administer the policy in a manner designed to promote the aims sought to be served thereby.

SECTION 3:  SEVERABILITY.  That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 4:  CONFLICTS.  All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency. 

 

                     SECTION 5: EFFECTIVE DATE.  This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
