A Resolution Authorizing the Conveyance of Certain Village Property and Accepting a Conveyance to the Village of Certain Property (1203 Lakeview Drive-Windham Lakes)

                     WHEREAS, the Village of Romeoville is a home rule municipality pursuant to the Illinois Constitution of 1970, and accordingly may exercise any power or perform any function pertaining to its own government and affairs unless expressly prohibited by law; and

 

                     WHEREAS, subsequent to a hearing before the Planning and Zoning Commission on June 14, 2022, the Village has heretofore adopted its Ordinance No. 22-1785, which approved a final development plan for ML Realty’s development of 1203 Lakeview Drive in Windham Lakes; and

 

                     WHEREAS, among other matters, the approvals contained within Ordinance No. 22-1785 contemplated that a portion of the site at 1203 Lakeview Drive (Lot 1 in Windham Lakes Resubdivision No. 27) would be conveyed to the Village by ML Realty to resolve an apparent encroachment of the Village-owned detention facility on the immediately adjacent parcel (Lot 2 in Windham Lakes Resubdivision No. 27);

 

                     WHEREAS, the approvals contained within Ordinance No. 22-1785 also contemplated that the Village would convey a portion of Lot 2 in Windham Lakes Resubdivision No. 27 to ML Realty to assist in the adjustment of the property line between Lots 1 and 2 in Windham Lakes Resubdivision No. 27; and

 

                     WHEREAS, it is in the best interests of the Village to proceed with the contemplated conveyances, as the same will secure its ownership and ability to access and maintain the detention facility on Lot 2 in Windham Lakes Resubdivision No. 27; and

 

                     WHEREAS, the Windham Lakes Association has represented to the Village and to ML Realty that it has no objection to the transactions contemplated herein.

 

 

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

 

                     SECTION ONE.  The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

 

                     SECTION TWO.   That the proper officers of the Village are authorized and directed to execute and attest to the execution of the deed attached hereto as Exhibit A, subject to final Village Manager and Village Attorney review, and to thereafter cause the same to be recorded, and further to accept the conveyance shown within the deed attached hereto as Exhibit B, and to take such other and further actions as may be necessary to consummate the transactions contemplated herein.

 

SECTION THREE.  That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

                     SECTION FOUR.  All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

                     SECTION FIVE.  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
