A Resolution Authorizing the Execution of an Addendum to a Contract Approved by Village Resolution No. 20-2865 between the Village of Romeoville and Harbour Contractors, Inc. (RAEC Expansion--Aquatics Center Building Construction Management Services), as modified by Addenda approved by Resolution No. 20-3009

WHEREAS, the Village of Romeoville and Harbour Contractors, Inc. have heretofore entered into a contract approved by Village Resolution No. 20-2865 pertaining to the Romeoville Athletic and Event Center (RAEC) Expansion Project (Aquatics Center Building Construction Management) and also into a contract approved by Village Resolution No. 19-2774 pertaining to preconstruction services for the RAEC Expansion Project; and
WHEREAS, the aforementioned contract has been further modified by the provisions of addenda approved by Resolution No. 20-3009, which, among other things, made certain modifications to the General Conditions amount as approved in the contract approved by Resolution No. 20-2865; and
WHEREAS, in the course of proceeding with the RAEC Expansion-Aquatics Center Project (“Project”), the Village and Harbour have agreed to a further revision to the General Conditions amount, as reflected and included within the final control estimate for the Project, which agreement is memorialized and set forth in the addendum attached hereto and incorporated herein by reference as Exhibit A.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Approval of Execution of Addenda: The proper officers of the Village are hereby authorized and directed to execute the addendum to the contract with Harbour Contractors, Inc. approved by Village Resolution Nos. 20-2865 and 19-2774, in the form attached hereto and incorporated herein as Exhibit A, all subject to the final review and approval of the Village Manager and the Village Attorney.
Section 3: Repealer: All other Resolutions or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions, or sections thereof.
Section 5: Effective Date: The Resolution shall take effect after its passage, approval, and publication in pamphlet form, as regulated by law.
