An Ordinance Annexing Certain Territory (Ward Farmhouse Site-Village of Romeoville)

WHEREAS, a written petition duly executed by the Village of Romeoville as owner of all of the approximately 6.3 acres of land contained within the territory hereinafter legally described in Exhibit A and depicted on the plat(s) of annexation attached hereto as Exhibit B (the "Property"), and by at least 51% of the electors residing therein, if any, has been filed with the Village Clerk of the Village of Romeoville, Will County, Illinois (the "Village") requesting annexation of the Property to the Village; and
WHEREAS, the Property is not within the corporate limits of any municipality but is contiguous to the corporate limits of the Village; and
WHEREAS, legal notices regarding the intention of the Village to annex the Property have been sent to all public bodies required to receive such notice by state statute; and
WHEREAS, the corporate authorities of the Village have determined that it is in the best interests of the health, safety, morals and welfare of the Village and its residents that the Property be annexed to the Village.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT
:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: ANNEXATION. The Property legally described on Exhibit A and depicted on the plat of annexation included as Exhibit B (both of which Exhibits are attached hereto and hereby made part of this Ordinance as if fully set forth herein) shall be and the same is hereby annexed to the Village of Romeoville, Will County, Illinois.
SECTION 3: RECORDING. The Village Clerk shall be and hereby is authorized and directed to record with the Recorder of Deeds of Will County, and to file with the County Clerk of Will County, all necessary notices and affidavits, a certified copy of this Ordinance, and the Plat of Annexation attached hereto as Exhibit "B" and made a part hereof, all in accordance with the applicable provisions of the Illinois Municipal Code.
SECTION 4: REPORTING. The Village Clerk is hereby authorized and directed to report by certified or registered mail such annexation to the election authorities having jurisdiction in the Property and the post office branches serving the Property within thirty (30) days of such annexation.
SECTION 5: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 6: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 7: REPEALER. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance shall be, and the same are hereby repealed.
SECTION 8: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law
