A Resolution to Accept the Quote for the Purchase of a Case Excavator using the Sourcewell Purchasing Contract

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, a quote was obtained for the purchase of a Case CX90E Crawler Excavator using the Sourcewell Purchasing Contract #32119-CNH for $124,921; and,
Whereas, the funds for the purchase are approved in the FY27 budget and will use the trade in values of a Case 580SM for $23,000 and a Case TR320 for $11,000 to offset the cost resulting in the net purchase cost of the Case CX90E $113,671; and,
Whereas, the Village Staff recommends waiving the bidding requirements for the purchase of a Case CX90E Crawler Excavator; and,
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the purchase of a Case CX90E Crawler Excavator in the amount of $113,671.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
