An Ordinance Granting a Variance from the Provisions of Chapter 150 (Building - Electrical - Continued Use of Natural Gas for Emergency Generator) for the Joliet Regional Port District Storage Hangar Project at 405 Jim Klick Drive

WHEREAS, the Joliet Regional Port District, has applied for a variance from the provisions of the 2021 National Electrical Code, Section 701.12(D)(2) and D(3) to permit the use of a back-up generator to be fueled by natural gas rather than providing a dual-fuel generator system; and
WHEREAS, Village staff has reviewed the application for variance submitted by the Joliet Regional Port District, and has determined that the building referenced within the application presently satisfies or will as constructed satisfy the proposed variance conditions; and
WHEREAS, the variance would allow the back-up generator for a storage building to be fueled by natural gas rather than providing a dual-fuel generator system. In this case, the applicant has coordinated with Nicor directly to confirm that the back-up generator powered by natural gas would be 99.99% reliable, as provided in Exhibit A, attached hereto and incorporated herein; and
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: VARIANCE. The variance is from the provisions of the 2021 National Electrical Code, Section 701.12(D)(2) and D(3) to permit the use of a back-up generator for a storage building to be fueled by natural gas rather than providing a dual-fuel generator system .
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
