A Resolution Approving a Cost-Sharing Agreement Between the City of Lockport, Village of Romeoville and Forest Preserve District of Will County for I and M Canal Path Costs

WHEREAS, the City of Lockport (“Lockport”) is a home rule municipality as defined by Section 6(a) of Article VII of the Illinois Constitution of 1970 and has its principal office located at 222 E. 9th Street, Lockport, Illinois 60441; and
WHEREAS, the Village of Romeoville (“Romeoville’) is a home rule municipality as defined by Section 6(a) of Article VII of the Illinois Constitution of 1970 and has its principal office located at 1050 W Romeo Rd, Romeoville, IL 60446; and
WHEREAS, the Forest Preserve District of Will County (“District”) is a body politic and corporate with offices located at 17540 W. Laraway Road, Joliet, Illinois 60433; and
WHEREAS, Lockport, Romeoville and District agree that it is mutually beneficial to provide improved recreational trail/path connections (the “Improvements”) between the District’s Centennial Trail and its Illinois and Michigan (I&M) Canal Trail; and
WHEREAS, the Village of Romeoville has determined that it is in the best interests of the Village to enter into an Agreement with the City of Lockport and the Forest Preserve District of Will County in substantially the form attached hereto as Exhibit A, setting forth various obligations of the parties with respect to the construction of the Improvements, the costs thereof, and the future maintenance thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
SECTION ONE. The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.
SECTION TWO. The Village President and Village Clerk are hereby authorized and directed to attest to the execution of an agreement with Lockport and the District in substantially the form attached hereto as Exhibit A, subject to final Village Manager and Village Attorney review and approval.
SECTION THREE. That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
SECTION FOUR. All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION FIVE. This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
