An Ordinance Approving a Special Use Permit for a Cannabis Infuser, Processor, and Transporter for GCF Industries, Inc. at 1413 Sherman Road Unit 90

WHEREAS, Tim Nitsch, representing GCF Industries, Inc (hereinafter referred to as “Applicant”) has requested the approval of a Special Use Permit for a Cannabis Infuser, Processor, and Transporter at 1413 Sherman Road Unit 90; and,
WHEREAS, the Applicant has provided a description and summary of the organization and its services as well as a description of how they meet the Special Use criteria attached as Exhibit A; and,
WHEREAS, the Applicant’s request for a Special Use Permit has met all of the procedural requirements of the Village of Romeoville, Village Board of Trustees, Planning & Zoning Commission, Development Review Committee, and the Code of Ordinances, as amended; and,
WHEREAS, the Planning & Zoning Commission held a Public Hearing on September 10, 2024 as described in the Report of the Planning and Zoning Commission attached as Exhibit B; and,
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
Section 1: That the above recitals and referenced reports are hereby incorporated and made a part of this Ordinance.
Section 2: That approval of the Special Use Permit for a Cannabis Infuser, Processor, and Transporter is hereby granted by the Village, which the Village President is hereby authorized to sign, and the Village Clerk is hereby authorized to attest thereto, that the said Special Use Permit has met all of the requirements as herewith attached and is authorized to proceed at the site legally described as follows:
Section 3: That the approval of the special use permit set forth in this Ordinance shall be specific and personal to the Applicant as the tenant of the above described site, and shall not run with the above described property or in any way be transferable to or for the benefit of any grantee, lessee, assignee or successor of the Applicant, and provided, further, that the approval of the special use permit set forth in this Ordinance shall terminate without the requirement of any further action by the Village in the event of any conveyance, transfer, lease, or other change in the identity of the ownership or occupancy of the above described site from the Applicant to any other entity or person.
Section 4: That this Ordinance shall become effective upon its passage, approval and publication as provided by law.
